國土資源部(bu)、國家(jia)(jia)發展(zhan)改(gai)革委(wei)、公(gong)安部(bu)、人(ren)力資源社(she)會保(bao)(bao)障部(bu)、住房城(cheng)鄉(xiang)建(jian)設部(bu)聯合(he)出(chu)(chu)臺了(le)《關于建(jian)設城(cheng)鎮(zhen)建(jian)設用地增加規(gui)模(mo)同吸納(na)農業轉移人(ren)口落戶數(shu)量掛鉤機制(zhi)的(de)實施意見》。國家(jia)(jia)資源部(bu)規(gui)劃司(si)(si)副司(si)(si)長(chang)周建(jian)春、國家(jia)(jia)發展(zhan)改(gai)革委(wei)地區(qu)司(si)(si)副處長(chang)王(wang)明利、人(ren)力資源社(she)會保(bao)(bao)障部(bu)農民工工作司(si)(si)副司(si)(si)長(chang)沈(shen)水(shui)生、住房城(cheng)鄉(xiang)建(jian)設部(bu)城(cheng)鄉(xiang)規(gui)劃司(si)(si)副調(diao)研員(yuan)潘(pan)海(hai)霞等有關人(ren)員(yuan)出(chu)(chu)席了(le)今日(ri)的(de)新聞(wen)發布會。
《實施意見(jian)》的(de)目標任(ren)務(wu)是,到(dao)2018年(nian),基本建立(li)(li)人地(di)(di)(di)掛(gua)鉤(gou)機制(zhi),形成部門聯動、上下銜(xian)接、有利于促進新型城鎮化發(fa)展的(de)建設(she)用(yong)地(di)(di)(di)供應制(zhi)度;到(dao)2020年(nian),全面建立(li)(li)科(ke)學(xue)合理的(de)人地(di)(di)(di)掛(gua)鉤(gou)機制(zhi)政(zheng)策(ce)體系,區域和(he)城鄉用(yong)地(di)(di)(di)結構布局更(geng)加優化,土地(di)(di)(di)節約(yue)集約(yue)利用(yong)水(shui)平顯著(zhu)提(ti)高(gao),為如期實現1億左右農業轉移人口和(he)其他常住人口在城鎮落戶(hu)提(ti)供用(yong)地(di)(di)(di)保障。
《實施意見》的主要措施包括五方面的內容:
一是實行差別化(hua)的(de)用地標準。綜合考慮城(cheng)鎮(zhen)容納空間(jian)等因素,現狀人(ren)(ren)均(jun)城(cheng)鎮(zhen)建(jian)設(she)用地不(bu)超(chao)過(guo)100平方(fang)(fang)米(mi)的(de)城(cheng)鎮(zhen),對于進(jin)城(cheng)落戶(hu)人(ren)(ren)口,按人(ren)(ren)均(jun)100平方(fang)(fang)米(mi)標準安(an)(an)排(pai)新(xin)增(zeng)城(cheng)鎮(zhen)建(jian)設(she)用地;現狀人(ren)(ren)均(jun)水平在100-150平方(fang)(fang)米(mi)之間(jian)的(de)城(cheng)鎮(zhen),按照(zhao)人(ren)(ren)均(jun)80平方(fang)(fang)米(mi)標準安(an)(an)排(pai);現狀人(ren)(ren)均(jun)水平超(chao)過(guo)150平方(fang)(fang)米(mi)的(de)城(cheng)鎮(zhen),按照(zhao)人(ren)(ren)均(jun)50平方(fang)(fang)米(mi)標準安(an)(an)排(pai)。超(chao)大(da)和特大(da)城(cheng)市的(de)中心(xin)城(cheng)區原則(ze)上不(bu)因吸(xi)納農(nong)業轉移人(ren)(ren)口安(an)(an)排(pai)新(xin)增(zeng)建(jian)設(she)用地。
二是實施規(gui)劃(hua)統籌管控(kong)。在土地(di)利用(yong)總(zong)體規(gui)劃(hua)、城鄉規(gui)劃(hua)編制(zhi)和修訂時,充分考慮區域經濟社會發展水平(ping)、土地(di)利用(yong)現狀、節約集約用(yong)地(di)要求和人口(kou)規(gui)模(mo)等(deng)因素,特別是進城落戶人口(kou)數(shu)量(liang)和流向,合(he)理安排(pai)城鎮新增建設用(yong)地(di)規(gui)模(mo)。原(yuan)有規(gui)模(mo)確實無法滿足進城落戶人口(kou)用(yong)地(di)需求的,可依法適當(dang)調整規(gui)劃(hua)。
三是(shi)改進(jin)用(yong)地(di)(di)計(ji)劃(hua)安(an)排。依據相關規劃(hua),更多考慮(lv)年度(du)進(jin)城落(luo)(luo)(luo)戶(hu)人(ren)(ren)(ren)口(kou)數量,合(he)理安(an)排年度(du)用(yong)地(di)(di)計(ji)劃(hua),保障(zhang)進(jin)城落(luo)(luo)(luo)戶(hu)人(ren)(ren)(ren)口(kou)用(yong)地(di)(di)需求。國(guo)家充分考慮(lv)各省(區、市(shi))上一年度(du)進(jin)城落(luo)(luo)(luo)戶(hu)人(ren)(ren)(ren)口(kou)規模,合(he)理分解計(ji)劃(hua)指(zhi)標;省(區、市(shi))根據所(suo)轄(xia)各市(shi)縣上一年度(du)進(jin)城落(luo)(luo)(luo)戶(hu)人(ren)(ren)(ren)口(kou)規模,專項安(an)排計(ji)劃(hua)指(zhi)標;縣(市(shi)、區)在(zai)組(zu)織城鎮(zhen)建設時,優先安(an)排吸納進(jin)城落(luo)(luo)(luo)戶(hu)人(ren)(ren)(ren)口(kou)鎮(zhen)的用(yong)地(di)(di)。
四(si)是優化土地(di)(di)供(gong)(gong)應(ying)結構。縣(xian)(市、區)要(yao)按(an)照方便進城(cheng)落(luo)戶人口生產生活的要(yao)求,統籌考慮各類各業(ye)建設(she)用地(di)(di)供(gong)(gong)應(ying),優先保障住房特(te)別是落(luo)戶人口的保障房,以及教育、醫療、養老、就業(ye)等民(min)生和城(cheng)鎮基礎設(she)施建設(she)用地(di)(di),合理安排(pai)必要(yao)的產業(ye)用地(di)(di)。
五是提高農村土地利用效率。結合農村宅基地制度改革試點的要求,允許進城落戶人員在本集體經濟組織內部自愿有償退出或轉讓宅基地,鼓勵農村土地經營權規范有序流轉。規范推進城鄉建設用(yong)地(di)增(zeng)減掛鉤(gou),通過整理復墾,增(zeng)加耕地(di)面積。
此(ci)(ci)外,《實(shi)(shi)施(shi)意(yi)見》實(shi)(shi)施(shi)中(zhong)還(huan)需(xu)要說明幾個問(wen)題。一是關(guan)于(yu)進城(cheng)(cheng)落戶(hu)人(ren)(ren)口(kou)人(ren)(ren)均(jun)(jun)用地(di)標準的(de)問(wen)題。《國家新(xin)型(xing)城(cheng)(cheng)鎮化(hua)規劃(2014-2020年)》提出,人(ren)(ren)均(jun)(jun)城(cheng)(cheng)市建(jian)設用地(di)嚴(yan)格控制在(zai)100平(ping)方(fang)(fang)米(mi)以(yi)內(nei)。據(ju)此(ci)(ci),《實(shi)(shi)施(shi)意(yi)見》提出現狀(zhuang)人(ren)(ren)均(jun)(jun)城(cheng)(cheng)鎮建(jian)設用地(di)不超(chao)(chao)過(guo)100平(ping)方(fang)(fang)米(mi)的(de),進城(cheng)(cheng)落戶(hu)人(ren)(ren)口(kou)按(an)人(ren)(ren)均(jun)(jun)100平(ping)方(fang)(fang)米(mi)安排新(xin)增城(cheng)(cheng)鎮建(jian)設用地(di);現狀(zhuang)人(ren)(ren)均(jun)(jun)水平(ping)超(chao)(chao)過(guo)100平(ping)方(fang)(fang)米(mi)的(de),適當降低(di)標準。同(tong)時(shi),綜(zong)合考慮東中(zhong)西部不同(tong)地(di)區經濟社會(hui)發(fa)展和自(zi)然條件的(de)差異,以(yi)及非(fei)農業轉(zhuan)移落戶(hu)人(ren)(ren)口(kou)和取(qu)得居住(zhu)證的(de)常住(zhu)非(fei)戶(hu)籍人(ren)(ren)口(kou)用地(di)需(xu)求,允許各省份根(gen)據(ju)實(shi)(shi)際對標準進行適當調整(zheng),幅(fu)度控制在(zai)10%以(yi)內(nei),既給予各地(di)一定的(de)靈活性,又防止地(di)方(fang)(fang)調整(zheng)幅(fu)度過(guo)大、擠(ji)占生態用地(di)和耕地(di)。
二是如何確保(bao)進(jin)(jin)城(cheng)落(luo)(luo)(luo)戶(hu)人口(kou)建(jian)設(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)需求(qiu)。為(wei)(wei)更(geng)好地(di)(di)(di)(di)促進(jin)(jin)農業(ye)轉移人口(kou)市民化(hua),《意見》提出,在土(tu)地(di)(di)(di)(di)利用(yong)(yong)(yong)(yong)總(zong)(zong)(zong)體(ti)規劃(hua)(hua)(hua)(hua)編制(zhi)(zhi)中要更(geng)加突出進(jin)(jin)城(cheng)落(luo)(luo)(luo)戶(hu)人口(kou)因素,合理(li)確定(ding)城(cheng)鎮建(jian)設(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)規模(mo);在制(zhi)(zhi)定(ding)三年滾動(dong)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)計劃(hua)(hua)(hua)(hua)和(he)(he)分解下(xia)達年度用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)計劃(hua)(hua)(hua)(hua)時(shi),充分考慮新(xin)(xin)型城(cheng)鎮化(hua)和(he)(he)進(jin)(jin)城(cheng)落(luo)(luo)(luo)戶(hu)人口(kou)的用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)需求(qiu),由各省(sheng)(區、市)根據進(jin)(jin)城(cheng)落(luo)(luo)(luo)戶(hu)人口(kou)專項安排進(jin)(jin)城(cheng)落(luo)(luo)(luo)戶(hu)人口(kou)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)指標,確保(bao)合理(li)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)需求(qiu)。圍繞落(luo)(luo)(luo)實區域(yu)發展總(zong)(zong)(zong)體(ti)戰略和(he)(he)新(xin)(xin)型城(cheng)鎮化(hua)等(deng),綜(zong)合國務院剛(gang)批準實施的《全國土(tu)地(di)(di)(di)(di)利用(yong)(yong)(yong)(yong)總(zong)(zong)(zong)體(ti)規劃(hua)(hua)(hua)(hua)綱要(2006-2020年)調整方案(an)》,特別(bie)考慮“三個1億人”等(deng)因素,提出了2015-2020年全國新(xin)(xin)增建(jian)設(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)總(zong)(zong)(zong)規模(mo)約3900萬畝(mu)(mu)(mu),其中包含了進(jin)(jin)城(cheng)落(luo)(luo)(luo)戶(hu)1億人口(kou)的各類用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)需求(qiu),初步(bu)估算為(wei)(wei)1200萬畝(mu)(mu)(mu)。如果按以(yi)往規劃(hua)(hua)(hua)(hua)編制(zhi)(zhi)方法,農村流(liu)動(dong)人口(kou)只按城(cheng)鎮人均建(jian)設(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)標準的60%安排用(yong)(yong)(yong)(yong)地(di)(di)(di)(di),1億農村流(liu)動(dong)人口(kou)用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)約為(wei)(wei)720萬畝(mu)(mu)(mu)。因此,從現行規劃(hua)(hua)(hua)(hua)看,土(tu)地(di)(di)(di)(di)供(gong)應方面(mian)可以(yi)滿(man)足進(jin)(jin)城(cheng)落(luo)(luo)(luo)戶(hu)人口(kou)發展用(yong)(yong)(yong)(yong)地(di)(di)(di)(di)需求(qiu)。
三(san)(san)是(shi)關于嚴(yan)格(ge)保(bao)(bao)護(hu)耕(geng)(geng)地(di)(di)(di)(di)和節約(yue)集約(yue)用(yong)地(di)(di)(di)(di)的(de)問(wen)題。我國(guo)(guo)人多地(di)(di)(di)(di)少(shao),土地(di)(di)(di)(di)資源特別是(shi)耕(geng)(geng)地(di)(di)(di)(di)資源十(shi)分寶貴(gui),必須倍加(jia)珍惜。耕(geng)(geng)地(di)(di)(di)(di)是(shi)我國(guo)(guo)最為寶貴(gui)的(de)資源,是(shi)國(guo)(guo)家(jia)糧食安全(quan)的(de)基石(shi),我們要(yao)(yao)像保(bao)(bao)護(hu)大(da)熊貓一樣來保(bao)(bao)護(hu)耕(geng)(geng)地(di)(di)(di)(di)。國(guo)(guo)家(jia)“十(shi)三(san)(san)五”規劃確(que)定的(de)18.65億畝耕(geng)(geng)地(di)(di)(di)(di)紅線,必須守住(zhu),不(bu)能突破,而且要(yao)(yao)實行數量(liang)(liang)(liang)、質量(liang)(liang)(liang)、生(sheng)態三(san)(san)位一體保(bao)(bao)護(hu)。因此(ci),實施人地(di)(di)(di)(di)掛鉤過程中(zhong),對已(yi)劃定的(de)城(cheng)市(shi)周(zhou)邊(bian)永久基本農田不(bu)能隨意占用(yong),要(yao)(yao)采(cai)取(qu)跳出去串聯(lian)式(shi)、衛(wei)星城(cheng)式(shi)發展,把好山好水好田融入城(cheng)市(shi)、融入市(shi)民生(sheng)活;要(yao)(yao)堅持最嚴(yan)格(ge)的(de)節約(yue)用(yong)地(di)(di)(di)(di)制度(du),建設用(yong)地(di)(di)(di)(di)要(yao)(yao)“管住(zhu)總量(liang)(liang)(liang)、嚴(yan)控增(zeng)量(liang)(liang)(liang)、盤活存量(liang)(liang)(liang)”,要(yao)(yao)劃定城(cheng)市(shi)開發邊(bian)界(jie),促進城(cheng)市(shi)緊(jin)湊(cou)、集約(yue)、高(gao)效(xiao)、綠色發展。
四是(shi)關于保障(zhang)進(jin)(jin)城落(luo)(luo)(luo)戶農(nong)(nong)民(min)(min)權益(yi)的問題(ti)。在我國,農(nong)(nong)民(min)(min)問題(ti)主要是(shi)土(tu)地(di)(di)問題(ti)。如(ru)何切實保護(hu)(hu)進(jin)(jin)城落(luo)(luo)(luo)戶農(nong)(nong)民(min)(min)的權益(yi),是(shi)《實施意(yi)見》的重點內容。按照中央要求(qiu),要切實維(wei)(wei)護(hu)(hu)進(jin)(jin)城落(luo)(luo)(luo)戶農(nong)(nong)民(min)(min)土(tu)地(di)(di)承包(bao)權、宅基(ji)地(di)(di)使用(yong)權、集體收(shou)益(yi)分(fen)配(pei)權,不(bu)得(de)以退出“三權”作(zuo)為(wei)(wei)農(nong)(nong)民(min)(min)進(jin)(jin)城落(luo)(luo)(luo)戶的條件(jian)。為(wei)(wei)解決進(jin)(jin)城落(luo)(luo)(luo)戶農(nong)(nong)業人口后顧(gu)之憂,《實施意(yi)見》提出,現階段不(bu)得(de)以退出農(nong)(nong)民(min)(min)土(tu)地(di)(di)承包(bao)權、宅基(ji)地(di)(di)使用(yong)權、集體收(shou)益(yi)分(fen)配(pei)權作(zuo)為(wei)(wei)農(nong)(nong)民(min)(min)進(jin)(jin)城落(luo)(luo)(luo)戶的條件(jian);充分(fen)尊重農(nong)(nong)民(min)(min)意(yi)愿,切實維(wei)(wei)護(hu)(hu)進(jin)(jin)城落(luo)(luo)(luo)戶農(nong)(nong)民(min)(min)土(tu)地(di)(di)承包(bao)權、宅基(ji)地(di)(di)使用(yong)權、集體收(shou)益(yi)分(fen)配(pei)權,保障(zhang)其(qi)合法權益(yi)。
