央行擬規定地方金融組織原則上不得跨省開展業務

  中(zhong)證網(wang)訊(記者 彭(peng)揚)中(zhong)國人民銀(yin)行(xing)網(wang)站(zhan)2021年(nian)12月(yue)(yue)31日消(xiao)息(xi),人民銀(yin)行(xing)會(hui)同有關(guan)方(fang)面(mian)研究(jiu)起草(cao)了(le)《地(di)方(fang)金(jin)融監督管理(li)條例(草(cao)案征求(qiu)意見(jian)(jian)稿)》(以下簡稱《條例》),開始向社會(hui)公開征求(qiu)意見(jian)(jian)。意見(jian)(jian)反饋截止時間為(wei)2022年(nian)1月(yue)(yue)30日。

  《條(tiao)例》起草說明表示,2017年(nian)以來,各省、自(zi)治區、直轄(xia)市成立地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)督(du)(du)管(guan)理(li)局,加(jia)強對地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)組織(zhi)的監(jian)(jian)(jian)管(guan),取(qu)得(de)明顯(xian)成效。但在日常監(jian)(jian)(jian)管(guan)和(he)(he)(he)(he)風險(xian)處置(zhi)中(zhong),因缺乏(fa)國家層面(mian)統一(yi)的地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)管(guan)立法,各方(fang)(fang)(fang)對地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)管(guan)職責分工的理(li)解不盡一(yi)致,部分機(ji)構和(he)(he)(he)(he)活(huo)動(dong)游離于金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)管(guan)之外,地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)督(du)(du)管(guan)理(li)部門也面(mian)臨(lin)監(jian)(jian)(jian)管(guan)依據不夠充分、執(zhi)法手(shou)段不足等問題。為切實防(fang)范和(he)(he)(he)(he)化(hua)解地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)風險(xian),健全防(fang)范化(hua)解金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)風險(xian)長效機(ji)制,有(you)(you)必(bi)要通(tong)過制定《條(tiao)例》,明確(que)地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)管(guan)規則和(he)(he)(he)(he)上(shang)位法依據,統一(yi)監(jian)(jian)(jian)管(guan)標(biao)準,構建權責清晰、執(zhi)法有(you)(you)力(li)的地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)管(guan)框架,確(que)保(bao)中(zhong)央對加(jia)強地(di)(di)(di)(di)(di)方(fang)(fang)(fang)金(jin)(jin)(jin)(jin)(jin)融(rong)(rong)(rong)監(jian)(jian)(jian)管(guan)的各項部署(shu)得(de)到落實。

  《條(tiao)例》共五章四(si)十條(tiao),按照“中(zhong)(zhong)央(yang)(yang)(yang)統一規(gui)則、地(di)(di)(di)方(fang)(fang)(fang)實施監(jian)(jian)管(guan),誰(shui)審批(pi)、誰(shui)監(jian)(jian)管(guan)、誰(shui)擔責(ze)(ze)”的原(yuan)則,將地(di)(di)(di)方(fang)(fang)(fang)各類(lei)金(jin)融業(ye)態納入統一監(jian)(jian)管(guan)框架,強化(hua)地(di)(di)(di)方(fang)(fang)(fang)金(jin)融風險(xian)防范(fan)化(hua)解和(he)處置(zhi)。具體(ti)看,主要內(nei)(nei)容包括:一是明確(que)地(di)(di)(di)方(fang)(fang)(fang)金(jin)融監(jian)(jian)管(guan)職責(ze)(ze),加(jia)強央(yang)(yang)(yang)地(di)(di)(di)協調配(pei)合。國務院(yuan)金(jin)融監(jian)(jian)督管(guan)理(li)部門(men)制定地(di)(di)(di)方(fang)(fang)(fang)金(jin)融組(zu)織(zhi)監(jian)(jian)管(guan)規(gui)則,對(dui)地(di)(di)(di)方(fang)(fang)(fang)金(jin)融監(jian)(jian)督管(guan)理(li)部門(men)予以業(ye)務指導。省(sheng)級人(ren)民政(zheng)府履行對(dui)地(di)(di)(di)方(fang)(fang)(fang)金(jin)融組(zu)織(zhi)的監(jian)(jian)督管(guan)理(li)和(he)風險(xian)處置(zhi)職責(ze)(ze),承擔地(di)(di)(di)方(fang)(fang)(fang)法人(ren)金(jin)融機(ji)構(gou)的風險(xian)處置(zhi)屬地(di)(di)(di)責(ze)(ze)任(ren),對(dui)轄區內(nei)(nei)防范(fan)和(he)處置(zhi)非法集資工作負(fu)總責(ze)(ze),維(wei)護屬地(di)(di)(di)金(jin)融穩定。建立中(zhong)(zhong)央(yang)(yang)(yang)與地(di)(di)(di)方(fang)(fang)(fang)金(jin)融監(jian)(jian)管(guan)協調雙(shuang)機(ji)制,加(jia)強統籌協調,強化(hua)中(zhong)(zhong)央(yang)(yang)(yang)和(he)地(di)(di)(di)方(fang)(fang)(fang)的監(jian)(jian)督管(guan)理(li)協作和(he)信息共享。

  二(er)是明(ming)確地(di)(di)方(fang)(fang)金(jin)(jin)(jin)(jin)融(rong)組(zu)織(zhi)(zhi)(zhi)(zhi)定義和監(jian)管(guan)(guan)規(gui)則(ze)(ze)。地(di)(di)方(fang)(fang)金(jin)(jin)(jin)(jin)融(rong)組(zu)織(zhi)(zhi)(zhi)(zhi)指(zhi)依(yi)法設(she)立(li)的小(xiao)額(e)貸款公(gong)司、融(rong)資擔保公(gong)司、區(qu)域(yu)性股權市場(chang)、典當(dang)行、融(rong)資租賃公(gong)司、商業保理(li)公(gong)司、地(di)(di)方(fang)(fang)資產管(guan)(guan)理(li)公(gong)司以及法律(lv)、行政(zheng)(zheng)法規(gui)和國(guo)(guo)務(wu)(wu)院授權省(sheng)級人民(min)政(zheng)(zheng)府監(jian)督(du)管(guan)(guan)理(li)的從事地(di)(di)方(fang)(fang)金(jin)(jin)(jin)(jin)融(rong)業務(wu)(wu)的其(qi)他機(ji)構。強調地(di)(di)方(fang)(fang)金(jin)(jin)(jin)(jin)融(rong)組(zu)織(zhi)(zhi)(zhi)(zhi)持牌經(jing)(jing)營,設(she)立(li)區(qu)域(yu)性股權市場(chang)應(ying)當(dang)經(jing)(jing)省(sheng)級人民(min)政(zheng)(zheng)府公(gong)示,并(bing)報國(guo)(guo)務(wu)(wu)院證券監(jian)督(du)管(guan)(guan)理(li)機(ji)構備案,設(she)立(li)其(qi)他地(di)(di)方(fang)(fang)金(jin)(jin)(jin)(jin)融(rong)組(zu)織(zhi)(zhi)(zhi)(zhi)應(ying)經(jing)(jing)省(sheng)級地(di)(di)方(fang)(fang)金(jin)(jin)(jin)(jin)融(rong)監(jian)督(du)管(guan)(guan)理(li)部門批準并(bing)頒發經(jing)(jing)營許可證。地(di)(di)方(fang)(fang)金(jin)(jin)(jin)(jin)融(rong)組(zu)織(zhi)(zhi)(zhi)(zhi)應(ying)當(dang)服務(wu)(wu)本(ben)地(di)(di),原(yuan)則(ze)(ze)上不得跨省(sheng)開(kai)展(zhan)業務(wu)(wu)。跨省(sheng)級行政(zheng)(zheng)區(qu)域(yu)開(kai)展(zhan)業務(wu)(wu)的規(gui)則(ze)(ze)由國(guo)(guo)務(wu)(wu)院或授權國(guo)(guo)務(wu)(wu)院金(jin)(jin)(jin)(jin)融(rong)監(jian)督(du)管(guan)(guan)理(li)部門制定。

  三是賦予(yu)地方(fang)(fang)金(jin)融(rong)監督管理(li)部門履職手段,加大(da)對違(wei)(wei)法違(wei)(wei)規(gui)行(xing)為(wei)(wei)的(de)處罰(fa)力度。明確地方(fang)(fang)金(jin)融(rong)監督管理(li)部門開展(zhan)現場檢查和(he)非現場監管,依法采取監督管理(li)措(cuo)施(shi)。建(jian)立(li)地方(fang)(fang)金(jin)融(rong)風(feng)險監測預警機制(zhi),視(shi)情按程序(xu)對地方(fang)(fang)金(jin)融(rong)組織采取暫停業務、限(xian)制(zhi)資產轉讓(rang)與資金(jin)運用、責令控股股東(dong)轉讓(rang)股權(quan)等風(feng)險處置措(cuo)施(shi)。分情形設置處罰(fa)標準,按照過罰(fa)相當原則(ze)可實施(shi)“雙罰(fa)”制(zhi),對長期多次從事同類金(jin)融(rong)違(wei)(wei)法行(xing)為(wei)(wei)可逐次處罰(fa)。

  四(si)是明確(que)地(di)(di)方對(dui)四(si)類(lei)(lei)機(ji)構(gou)的(de)監管要(yao)(yao)求(qiu)。明確(que)地(di)(di)方各(ge)類(lei)(lei)交易場所、開(kai)展(zhan)信用互助的(de)農民專(zhuan)業(ye)合(he)作(zuo)社、投資(zi)公司、社會(hui)眾(zhong)籌(chou)機(ji)構(gou)等四(si)類(lei)(lei)機(ji)構(gou)不得(de)開(kai)展(zhan)的(de)業(ye)務類(lei)(lei)型。對(dui)地(di)(di)方各(ge)類(lei)(lei)交易場所要(yao)(yao)嚴格準入,引導農民專(zhuan)業(ye)合(he)作(zuo)社規(gui)范(fan)(fan)開(kai)展(zhan)信用互助業(ye)務,對(dui)不符合(he)批設或備案條(tiao)(tiao)件的(de)投資(zi)公司以及社會(hui)眾(zhong)籌(chou)機(ji)構(gou)提(ti)出限期清理要(yao)(yao)求(qiu)。四(si)類(lei)(lei)機(ji)構(gou)的(de)風險防范(fan)(fan)、處(chu)置(zhi)和處(chu)罰,參照《條(tiao)(tiao)例(li)》規(gui)定執行。

  五(wu)是明(ming)確對(dui)(dui)(dui)非法金(jin)融(rong)(rong)活(huo)動(dong)的(de)(de)監測、認定(ding)、處(chu)置(zhi)原則。明(ming)確國(guo)務院金(jin)融(rong)(rong)管(guan)理部門(men)和(he)(he)地方金(jin)融(rong)(rong)監督(du)管(guan)理部門(men)應當加(jia)強對(dui)(dui)(dui)非法金(jin)融(rong)(rong)活(huo)動(dong)的(de)(de)監測、認定(ding)和(he)(he)處(chu)置(zhi)。對(dui)(dui)(dui)區域性(xing)非法金(jin)融(rong)(rong)活(huo)動(dong)和(he)(he)全國(guo)性(xing)重大(da)非法金(jin)融(rong)(rong)活(huo)動(dong)提(ti)出認定(ding)和(he)(he)處(chu)置(zhi)安排。

  六是(shi)設(she)置過渡(du)期(qi)安排,確保平(ping)穩過渡(du)。對《條例》施行前設(she)立的(de)地(di)方(fang)金融(rong)(rong)組織,在地(di)方(fang)金融(rong)(rong)監督管(guan)理部門(men)(men)規(gui)定的(de)期(qi)限內達到規(gui)定條件。已跨省級行政區域(yu)開展業務(wu)且需要整改的(de),由國務(wu)院金融(rong)(rong)監督管(guan)理部門(men)(men)明確過渡(du)期(qi)安排。
