全國人大代表、齊魯證券(quan)(quan)董(dong)事長李瑋在接受中國證券(quan)(quan)報記者采訪(fang)時(shi)表示(shi),應統(tong)一完善債券(quan)(quan)市(shi)場(chang)監管(guan)體(ti)制和監管(guan)法(fa)規。
李瑋表示(shi),長期以來,我國債(zhai)券發(fa)(fa)行(xing)市(shi)(shi)(shi)場(chang)(chang)(chang)呈(cheng)現“五龍治(zhi)水”格局,由于發(fa)(fa)行(xing)和(he)監(jian)管制(zhi)度(du)相互獨立、差(cha)異明顯,并形成(cheng)銀行(xing)間債(zhai)券市(shi)(shi)(shi)場(chang)(chang)(chang)與交易(yi)所債(zhai)券市(shi)(shi)(shi)場(chang)(chang)(chang)兩個(ge)相互割(ge)裂(lie)的(de)市(shi)(shi)(shi)場(chang)(chang)(chang)和(he)監(jian)管體(ti)(ti)系。債(zhai)券法制(zhi)的(de)不統(tong)一、監(jian)管體(ti)(ti)制(zhi)的(de)分散化導致我國債(zhai)券市(shi)(shi)(shi)場(chang)(chang)(chang)發(fa)(fa)展缺乏有效監(jian)管和(he)統(tong)一規(gui)(gui)劃,債(zhai)券市(shi)(shi)(shi)場(chang)(chang)(chang)總體(ti)(ti)規(gui)(gui)模較小,影響了資本(ben)市(shi)(shi)(shi)場(chang)(chang)(chang)有機整體(ti)(ti)的(de)形成(cheng)和(he)發(fa)(fa)展。
李瑋建(jian)議,應完善(shan)現(xian)行(xing)公(gong)司(si)(si)債(zhai)(zhai)券(quan)(quan)(quan)相關法(fa)(fa)律制(zhi)(zhi)度。一是(shi)(shi)統一公(gong)司(si)(si)債(zhai)(zhai)券(quan)(quan)(quan)監管法(fa)(fa)制(zhi)(zhi),明確(que)《證(zheng)(zheng)券(quan)(quan)(quan)法(fa)(fa)》作為公(gong)司(si)(si)債(zhai)(zhai)券(quan)(quan)(quan)基礎性(xing)法(fa)(fa)律的(de)地位;二是(shi)(shi)建(jian)立(li)全國統一的(de)債(zhai)(zhai)券(quan)(quan)(quan)市場監管體制(zhi)(zhi)并(bing)在《證(zheng)(zheng)券(quan)(quan)(quan)法(fa)(fa)》中予以明確(que);三是(shi)(shi)統一公(gong)司(si)(si)債(zhai)(zhai)券(quan)(quan)(quan)認定標(biao)準,將實踐中存(cun)在的(de)具有債(zhai)(zhai)券(quan)(quan)(quan)特征的(de)各種名目的(de)債(zhai)(zhai)券(quan)(quan)(quan)納入(ru)公(gong)司(si)(si)債(zhai)(zhai)券(quan)(quan)(quan)范圍;四是(shi)(shi)放松行(xing)政(zheng)管制(zhi)(zhi),建(jian)立(li)債(zhai)(zhai)券(quan)(quan)(quan)發行(xing)注冊制(zhi)(zhi);五是(shi)(shi)立(li)足債(zhai)(zhai)性(xing)特點,修改(gai)完善(shan)現(xian)行(xing)公(gong)司(si)(si)債(zhai)(zhai)券(quan)(quan)(quan)制(zhi)(zhi)度。
