事業(ye)單位(wei)工作人員的“鐵飯碗”即將全面打(da)破。我(wo)國(guo)《事業(ye)單位(wei)人事管理條例(li)》(以下簡稱(cheng)條例(li))將于(yu)明天實施。省人社廳昨日發布了關于(yu)條例(li)的解讀,指出(chu)條例(li)實施后(hou)最大(da)的轉變是將事業(ye)單位(wei)與職工確定為“合(he)同關系(xi)”,下狠招打(da)破終身(shen)制(zhi),實現人員能進能出(chu)。
條例規定(ding),事(shi)業(ye)(ye)(ye)單(dan)位與工(gong)(gong)(gong)作(zuo)人(ren)員訂(ding)立的(de)聘用合(he)(he)同,期限(xian)一般不低于三年(nian)。事(shi)業(ye)(ye)(ye)單(dan)位工(gong)(gong)(gong)作(zuo)人(ren)員連續曠工(gong)(gong)(gong)超過15個(ge)工(gong)(gong)(gong)作(zuo)日(ri),或(huo)者(zhe)一年(nian)內累計(ji)曠工(gong)(gong)(gong)超過30個(ge)工(gong)(gong)(gong)作(zuo)日(ri)的(de),事(shi)業(ye)(ye)(ye)單(dan)位可以(yi)解除聘用合(he)(he)同。事(shi)業(ye)(ye)(ye)單(dan)位工(gong)(gong)(gong)作(zuo)人(ren)員年(nian)度考(kao)核(he)不合(he)(he)格、且(qie)不同意調(diao)整(zheng)工(gong)(gong)(gong)作(zuo)崗位;或(huo)者(zhe)連續兩年(nian)年(nian)度考(kao)核(he)不合(he)(he)格的(de),事(shi)業(ye)(ye)(ye)單(dan)位提(ti)前30天書面通(tong)知,可以(yi)解除聘用合(he)(he)同。
省人(ren)社廳有關(guan)負責人(ren)指出,該條(tiao)例最大的(de)(de)(de)(de)轉變(bian)是(shi),把事(shi)業單(dan)位與工作(zuo)人(ren)員(yuan)之間(jian)的(de)(de)(de)(de)關(guan)系確(que)定為“合同關(guan)系”,打破終(zhong)身制,建(jian)立包括合同聘用(yong)、公平競爭、激勵約束、權益保障的(de)(de)(de)(de)用(yong)人(ren)機制,逐步實現人(ren)員(yuan)能進(jin)能出、崗位能上能下、待遇能高能低的(de)(de)(de)(de)目標,進(jin)一步搞活用(yong)人(ren)制度(du)。
《事(shi)業(ye)單(dan)位(wei)人(ren)(ren)事(shi)管理條例(li)》確定,事(shi)業(ye)單(dan)位(wei)作(zuo)(zuo)為(wei)法(fa)人(ren)(ren),與工作(zuo)(zuo)人(ren)(ren)員通過簽訂(ding)聘用(yong)(yong)(yong)合(he)(he)同(tong),建立人(ren)(ren)事(shi)關系,確立了雙方(fang)平等人(ren)(ren)事(shi)主體的法(fa)律地位(wei),工作(zuo)(zuo)人(ren)(ren)員可以自(zi)主應聘,按聘用(yong)(yong)(yong)合(he)(he)同(tong)履行職責、享(xiang)有待遇(yu)。自(zi)2002年至今,通過推行聘用(yong)(yong)(yong)制度,全國90%的事(shi)業(ye)單(dan)位(wei)工作(zuo)(zuo)人(ren)(ren)員已經簽訂(ding)了聘用(yong)(yong)(yong)合(he)(he)同(tong)。
條(tiao)例還規(gui)定,除國家政策性安置、按照(zhao)人事(shi)管理權限(xian)由上級(ji)任命、涉密崗(gang)位等(deng)人員外,事(shi)業單(dan)位新(xin)聘用工作人員,應當面向社會公開招聘。
日前(qian),國家人社部(bu)部(bu)長尹(yin)蔚民表示,目前(qian)事(shi)業單位(wei)(wei)的聘(pin)(pin)(pin)(pin)用(yong)(yong)合(he)同(tong)(tong)(tong)簽(qian)訂工(gong)作還(huan)有“死角”,不少單位(wei)(wei)的合(he)同(tong)(tong)(tong)管理流于形(xing)式、作用(yong)(yong)還(huan)沒(mei)有真正發揮(hui),聘(pin)(pin)(pin)(pin)用(yong)(yong)合(he)同(tong)(tong)(tong)還(huan)沒(mei)有充(chong)分體現(xian)行業、崗位(wei)(wei)特點(dian)。條例實(shi)施后(hou)要繼續擴(kuo)大(da)聘(pin)(pin)(pin)(pin)用(yong)(yong)制度的推行面,做到(dao)聘(pin)(pin)(pin)(pin)用(yong)(yong)合(he)同(tong)(tong)(tong)應簽(qian)盡(jin)簽(qian),消除制度推行的死角。 (記者廖靖文 通(tong)訊員粵(yue)仁宣)
