據新華社11月2日消息,近日,中共(gong)中央辦(ban)公(gong)廳、國(guo)務(wu)院辦(ban)公(gong)廳印發了《深(shen)化(hua)農村改革(ge)綜合性(xing)實施方案》,并發出通知,要求各(ge)地區各(ge)部門結合實際認真貫徹執行。
《深化農(nong)(nong)(nong)村(cun)改(gai)革綜(zong)合性(xing)(xing)實(shi)施(shi)方(fang)案》主要(yao)內容:農(nong)(nong)(nong)村(cun)改(gai)革是全面深化改(gai)革的(de)重(zhong)要(yao)內容。根據黨中央、國務(wu)院(yuan)的(de)決(jue)策部署,農(nong)(nong)(nong)村(cun)各項(xiang)改(gai)革正在扎實(shi)開展,一些(xie)重(zhong)要(yao)改(gai)革事(shi)項(xiang)試點(dian)工作正在有序推進(jin)(jin)。當(dang)前(qian),我國經濟發展進(jin)(jin)入新常態,新型(xing)工業化、信息化、城(cheng)鎮化、農(nong)(nong)(nong)業現代化持續(xu)推進(jin)(jin),農(nong)(nong)(nong)村(cun)經濟社會(hui)深刻變(bian)革,農(nong)(nong)(nong)村(cun)改(gai)革涉及的(de)利益(yi)關系(xi)更(geng)(geng)加(jia)(jia)(jia)(jia)復雜、目標更(geng)(geng)加(jia)(jia)(jia)(jia)多元、影響因素更(geng)(geng)加(jia)(jia)(jia)(jia)多樣、任(ren)務(wu)也更(geng)(geng)加(jia)(jia)(jia)(jia)艱巨。農(nong)(nong)(nong)村(cun)改(gai)革綜(zong)合性(xing)(xing)強,靠單兵突進(jin)(jin)難(nan)以奏效(xiao),必須樹立系(xi)統(tong)性(xing)(xing)思維,做好(hao)整體(ti)謀劃和頂層設計,找準牽一發而動全身的(de)牛鼻子(zi)和主要(yao)矛盾,進(jin)(jin)一步提高農(nong)(nong)(nong)村(cun)改(gai)革決(jue)策的(de)科(ke)學性(xing)(xing)。要(yao)從總(zong)體(ti)上把握好(hao)農(nong)(nong)(nong)村(cun)改(gai)革的(de)方(fang)向(xiang),提出(chu)深化農(nong)(nong)(nong)村(cun)改(gai)革總(zong)的(de)目標、大(da)的(de)原則、基(ji)本任(ren)務(wu)、重(zhong)要(yao)路(lu)徑,從全局上更(geng)(geng)好(hao)地指導和協調農(nong)(nong)(nong)村(cun)各項(xiang)改(gai)革,加(jia)(jia)(jia)(jia)強各項(xiang)改(gai)革之間的(de)銜(xian)接配套(tao),最大(da)限度(du)釋放改(gai)革的(de)綜(zong)合效(xiao)應(ying)。
根據中央統一部署,從提高農村改革的系統性(xing)、整體性(xing)、協同性(xing)出發(fa),特制定深(shen)化(hua)農村改革綜合性(xing)實施方案(an)。
一、總體要求
(一)指導(dao)思想。全(quan)(quan)面(mian)貫(guan)徹(che)黨的十(shi)八大(da)和(he)十(shi)八屆二中(zhong)、三中(zhong)、四中(zhong)全(quan)(quan)會精神,以鄧小平(ping)(ping)理(li)論、“三個代(dai)表”重要(yao)思想、科學發展(zhan)觀為(wei)指導(dao),深入貫(guan)徹(che)習(xi)近平(ping)(ping)總書(shu)記系列重要(yao)講話精神,認真落實(shi)黨中(zhong)央(yang)、國(guo)務院(yuan)的決(jue)策部署,主動(dong)適(shi)應經濟發展(zhan)新常(chang)態,緊緊圍繞全(quan)(quan)面(mian)建成小康社會、全(quan)(quan)面(mian)深化改革、全(quan)(quan)面(mian)依法治國(guo)、全(quan)(quan)面(mian)從嚴治黨的戰(zhan)略(lve)布(bu)局,不(bu)斷鞏固和(he)完善中(zhong)國(guo)特色社會主義農(nong)(nong)(nong)村(cun)基本經濟制(zhi)度,加(jia)快(kuai)農(nong)(nong)(nong)業(ye)發展(zhan)方式轉(zhuan)變,健全(quan)(quan)保(bao)障國(guo)家糧食安全(quan)(quan)、促(cu)進農(nong)(nong)(nong)業(ye)可持(chi)續(xu)發展(zhan)和(he)農(nong)(nong)(nong)民持(chi)續(xu)增收的體制(zhi)機制(zhi),著力破除城鄉(xiang)二元結構的體制(zhi)障礙,為(wei)加(jia)快(kuai)推(tui)進中(zhong)國(guo)特色農(nong)(nong)(nong)業(ye)農(nong)(nong)(nong)村(cun)現代(dai)化提供制(zhi)度保(bao)障,為(wei)實(shi)現“兩個一百年”奮斗目標和(he)中(zhong)華(hua)民族偉大(da)復興(xing)的中(zhong)國(guo)夢奠定堅(jian)實(shi)基礎(chu)。
(二)目標任務。到2020年,農村各類所有制經濟尤其是農村集體資產所有權、農戶土地承包經營權和農民財產權的保護制度更加完善,新型農業經營體系、農業支持保護體系、農業社會化服務體系、農業科技創新體系、適合農業農村特點的農村金融體系更加健全,城鄉經濟社會發展一體化體制機制基本建立,農村社會治理體系和農村基層組織制度更加完善,農民民主權利得到更好保障,農業農村法律法規進一步完善并加強,農村基層法治水平進一步提高,農業現代化水平和農民生活水平進一步提升,農村經濟社會發展更具活力。
(三)基本原則
1.堅(jian)持農(nong)村多種所(suo)有(you)(you)制(zhi)經(jing)濟(ji)(ji)共同(tong)發展(zhan)。在堅(jian)持土地(di)(di)公有(you)(you)制(zhi)性(xing)質基礎上,加(jia)強(qiang)對農(nong)村各種所(suo)有(you)(you)制(zhi)經(jing)濟(ji)(ji)組(zu)織(zhi)和農(nong)民家(jia)(jia)庭合法(fa)財產權益(yi)的保護,賦予農(nong)村各種所(suo)有(you)(you)制(zhi)經(jing)濟(ji)(ji)組(zu)織(zhi)同(tong)等(deng)(deng)的市場(chang)主體地(di)(di)位,保證(zheng)其(qi)依法(fa)公平參與市場(chang)競爭、同(tong)等(deng)(deng)受到(dao)法(fa)律保護,促進農(nong)村集體經(jing)濟(ji)(ji)、農(nong)戶家(jia)(jia)庭經(jing)濟(ji)(ji)、農(nong)民合作經(jing)濟(ji)(ji)、各種私人和股(gu)份制(zhi)經(jing)濟(ji)(ji)、供銷(xiao)合作社經(jing)濟(ji)(ji)以及國有(you)(you)農(nong)場(chang)林(lin)場(chang)等(deng)(deng)國有(you)(you)經(jing)濟(ji)(ji)共同(tong)發展(zhan)。
2.堅(jian)持和(he)(he)完善農村(cun)基本經營(ying)(ying)制度(du)。把握好土(tu)地集體所有制和(he)(he)家庭承(cheng)包(bao)經營(ying)(ying)的關系(xi),現(xian)有農村(cun)土(tu)地承(cheng)包(bao)關系(xi)保持穩定并長久(jiu)不變,落(luo)實集體所有權(quan),穩定農戶承(cheng)包(bao)權(quan),放活土(tu)地經營(ying)(ying)權(quan),實行“三權(quan)分置”。堅(jian)持家庭經營(ying)(ying)在農業中的基礎性地位,創(chuang)新農業經營(ying)(ying)組織方式,推進(jin)家庭經營(ying)(ying)、集體經營(ying)(ying)、合作經營(ying)(ying)、企業經營(ying)(ying)等共同發展。
3.堅持(chi)(chi)社會主(zhu)義市場(chang)(chang)經(jing)濟(ji)改革方向。調整不適應農村(cun)社會生(sheng)產力發展要(yao)求(qiu)的(de)生(sheng)產關系,健(jian)全符合社會主(zhu)義市場(chang)(chang)經(jing)濟(ji)要(yao)求(qiu)的(de)農村(cun)經(jing)濟(ji)體制,充分發揮市場(chang)(chang)在(zai)資源配置(zhi)中的(de)決定(ding)性作用(yong),加強國家對農業(ye)的(de)支持(chi)(chi)保護,促進農業(ye)盡(jin)快轉到數量(liang)質量(liang)效(xiao)益(yi)并重(zhong)、注重(zhong)提高(gao)競爭力、注重(zhong)農業(ye)技術創新、注重(zhong)可(ke)持(chi)(chi)續的(de)集約發展上來。
4.堅持保(bao)障農民權(quan)(quan)益。把實現好(hao)、維護(hu)好(hao)、發展好(hao)廣大農民的根本利(li)益作(zuo)為深化農村改(gai)革(ge)的出(chu)發點和(he)落(luo)腳點,切實保(bao)障農民合(he)法經濟利(li)益,尊重(zhong)農民民主權(quan)(quan)利(li)。
5.堅持統(tong)籌(chou)兼顧。統(tong)籌(chou)考(kao)慮農(nong)業和農(nong)村發展,統(tong)籌(chou)考(kao)慮城鄉(xiang)改革發展,統(tong)籌(chou)考(kao)慮公平(ping)和效率。
6.堅(jian)持循序(xu)漸進、試(shi)(shi)點先行(xing)。發(fa)揮好基(ji)層和群眾首創精神,在(zai)把握方向、堅(jian)守底線前提下,鼓勵積極探(tan)索、大(da)膽創新(xin),允(yun)許采取差異性(xing)、過渡性(xing)的(de)(de)制度和政策安(an)排。認真組織好農村改革(ge)(ge)試(shi)(shi)點工作,及時總結可復(fu)制、可推廣的(de)(de)經(jing)驗。對(dui)突破現行(xing)法(fa)律法(fa)規的(de)(de)重大(da)改革(ge)(ge),要按程序(xu)報批,取得(de)授權,在(zai)一定范(fan)圍(wei)內開展試(shi)(shi)點。
7.堅持黨對“三農(nong)(nong)”工作(zuo)的領(ling)導(dao)。必須(xu)始終把加(jia)強黨對“三農(nong)(nong)”工作(zuo)的領(ling)導(dao)作(zuo)為推進農(nong)(nong)村改革(ge)發(fa)展的政治保證(zheng),提高依法做好“三農(nong)(nong)”工作(zuo)的能(neng)力(li)和水平。在中(zhong)央的統(tong)一領(ling)導(dao)下,積(ji)極(ji)穩妥深化農(nong)(nong)村各項改革(ge)。
二、關鍵領(ling)域和重大舉措
全(quan)面(mian)深化農(nong)村(cun)改革(ge)(ge)涉(she)及經(jing)濟、政治、文化、社會、生態文明和基層黨建等領(ling)域,涉(she)及農(nong)村(cun)多種所(suo)有制經(jing)濟主體(ti)。當前和今(jin)后一(yi)(yi)個時期,深化農(nong)村(cun)改革(ge)(ge)要(yao)聚焦農(nong)村(cun)集體(ti)產權制度(du)、農(nong)業(ye)經(jing)營制度(du)、農(nong)業(ye)支(zhi)持保護(hu)制度(du)、城(cheng)鄉(xiang)發展一(yi)(yi)體(ti)化體(ti)制機制和農(nong)村(cun)社會治理制度(du)等5大領(ling)域。對(dui)這5大領(ling)域改革(ge)(ge)的核心問題(ti),要(yao)明確大的方(fang)向(xiang)、主要(yao)內容和重大方(fang)針對(dui)策,進一(yi)(yi)步(bu)理清改革(ge)(ge)思路。
(一(yi))深化農村集體(ti)產權制度改(gai)革
以土(tu)地(di)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)所(suo)(suo)有為(wei)基(ji)(ji)礎的(de)(de)農(nong)(nong)(nong)村(cun)(cun)(cun)(cun)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)所(suo)(suo)有制(zhi)(zhi),是社會主義(yi)公有制(zhi)(zhi)的(de)(de)重(zhong)(zhong)要形(xing)式,是實現(xian)農(nong)(nong)(nong)民(min)共(gong)同富(fu)裕的(de)(de)制(zhi)(zhi)度(du)保障。在土(tu)地(di)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)所(suo)(suo)有基(ji)(ji)礎上建立(li)(li)的(de)(de)農(nong)(nong)(nong)村(cun)(cun)(cun)(cun)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)經(jing)(jing)濟(ji)組織(zhi)(zhi)(zhi)制(zhi)(zhi)度(du),與村(cun)(cun)(cun)(cun)民(min)自治組織(zhi)(zhi)(zhi)制(zhi)(zhi)度(du)相交織(zhi)(zhi)(zhi),構成了我國農(nong)(nong)(nong)村(cun)(cun)(cun)(cun)治理的(de)(de)基(ji)(ji)本(ben)框(kuang)架(jia),為(wei)中國特(te)色農(nong)(nong)(nong)業農(nong)(nong)(nong)村(cun)(cun)(cun)(cun)現(xian)代化提供了基(ji)(ji)本(ben)的(de)(de)制(zhi)(zhi)度(du)支撐(cheng)。建立(li)(li)健全符合社會主義(yi)市(shi)場(chang)經(jing)(jing)濟(ji)體(ti)制(zhi)(zhi)要求和社會主義(yi)初級階段(duan)實際的(de)(de)農(nong)(nong)(nong)村(cun)(cun)(cun)(cun)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)產(chan)權(quan)制(zhi)(zhi)度(du),必須以保護農(nong)(nong)(nong)民(min)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)經(jing)(jing)濟(ji)組織(zhi)(zhi)(zhi)成員(yuan)權(quan)利為(wei)核心,以明晰(xi)農(nong)(nong)(nong)村(cun)(cun)(cun)(cun)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)產(chan)權(quan)歸屬、賦予農(nong)(nong)(nong)民(min)更多財產(chan)權(quan)利為(wei)重(zhong)(zhong)點,探索社會主義(yi)市(shi)場(chang)經(jing)(jing)濟(ji)條件下農(nong)(nong)(nong)村(cun)(cun)(cun)(cun)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)所(suo)(suo)有制(zhi)(zhi)經(jing)(jing)濟(ji)的(de)(de)有效組織(zhi)(zhi)(zhi)形(xing)式和經(jing)(jing)營方式,確保集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)經(jing)(jing)濟(ji)發展成果惠及本(ben)集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)所(suo)(suo)有成員(yuan),進一步發揮集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)經(jing)(jing)濟(ji)優越(yue)性,進一步調動集(ji)(ji)(ji)(ji)(ji)(ji)(ji)體(ti)經(jing)(jing)濟(ji)組織(zhi)(zhi)(zhi)成員(yuan)積極性。
1.深(shen)化農(nong)(nong)村土地(di)(di)(di)制度改(gai)革。堅守土地(di)(di)(di)公有(you)(you)性質不(bu)改(gai)變、耕地(di)(di)(di)紅線不(bu)突(tu)破、農(nong)(nong)民(min)利(li)益不(bu)受(shou)損“三(san)條底(di)線”,防止犯顛覆性錯誤。深(shen)化農(nong)(nong)村土地(di)(di)(di)制度改(gai)革的(de)基(ji)本方向是(shi):落(luo)(luo)實集(ji)(ji)(ji)(ji)(ji)體(ti)所有(you)(you)權(quan)(quan),穩定(ding)農(nong)(nong)戶承包(bao)權(quan)(quan),放(fang)活(huo)土地(di)(di)(di)經(jing)營(ying)權(quan)(quan)。落(luo)(luo)實集(ji)(ji)(ji)(ji)(ji)體(ti)所有(you)(you)權(quan)(quan),就(jiu)(jiu)是(shi)落(luo)(luo)實“農(nong)(nong)民(min)集(ji)(ji)(ji)(ji)(ji)體(ti)所有(you)(you)的(de)不(bu)動(dong)產(chan)和動(dong)產(chan),屬于本集(ji)(ji)(ji)(ji)(ji)體(ti)成員(yuan)集(ji)(ji)(ji)(ji)(ji)體(ti)所有(you)(you)”的(de)法律規(gui)(gui)定(ding),明確(que)界定(ding)農(nong)(nong)民(min)的(de)集(ji)(ji)(ji)(ji)(ji)體(ti)成員(yuan)權(quan)(quan),明晰(xi)集(ji)(ji)(ji)(ji)(ji)體(ti)土地(di)(di)(di)產(chan)權(quan)(quan)歸屬,實現集(ji)(ji)(ji)(ji)(ji)體(ti)產(chan)權(quan)(quan)主(zhu)體(ti)清晰(xi)。穩定(ding)農(nong)(nong)戶承包(bao)權(quan)(quan),就(jiu)(jiu)是(shi)要依法公正地(di)(di)(di)將集(ji)(ji)(ji)(ji)(ji)體(ti)土地(di)(di)(di)的(de)承包(bao)經(jing)營(ying)權(quan)(quan)落(luo)(luo)實到本集(ji)(ji)(ji)(ji)(ji)體(ti)組織(zhi)的(de)每個農(nong)(nong)戶。放(fang)活(huo)土地(di)(di)(di)經(jing)營(ying)權(quan)(quan),就(jiu)(jiu)是(shi)允許承包(bao)農(nong)(nong)戶將土地(di)(di)(di)經(jing)營(ying)權(quan)(quan)依法自(zi)愿配置給有(you)(you)經(jing)營(ying)意(yi)愿和經(jing)營(ying)能力的(de)主(zhu)體(ti),發展多種形式的(de)適度規(gui)(gui)模經(jing)營(ying)。
一(yi)是開展農(nong)(nong)村(cun)土(tu)地(di)(di)征(zheng)(zheng)收(shou)、集體經(jing)營性(xing)建設(she)(she)用(yong)(yong)地(di)(di)入(ru)市、宅(zhai)基(ji)(ji)地(di)(di)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)改(gai)(gai)革試點。及時總結(jie)經(jing)驗、不斷完善,形成可復制(zhi)(zhi)(zhi)(zhi)、可推廣的(de)(de)(de)改(gai)(gai)革成果。農(nong)(nong)村(cun)土(tu)地(di)(di)征(zheng)(zheng)收(shou)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)改(gai)(gai)革的(de)(de)(de)基(ji)(ji)本思路(lu)是:縮小土(tu)地(di)(di)征(zheng)(zheng)收(shou)范圍,規范土(tu)地(di)(di)征(zheng)(zheng)收(shou)程序(xu),完善對(dui)被征(zheng)(zheng)地(di)(di)農(nong)(nong)民合(he)(he)理(li)(li)、規范、多元保(bao)(bao)障機制(zhi)(zhi)(zhi)(zhi),建立兼顧國(guo)家、集體、個人的(de)(de)(de)土(tu)地(di)(di)增(zeng)值收(shou)益分(fen)配(pei)機制(zhi)(zhi)(zhi)(zhi),合(he)(he)理(li)(li)提高個人收(shou)益。集體經(jing)營性(xing)建設(she)(she)用(yong)(yong)地(di)(di)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)改(gai)(gai)革的(de)(de)(de)基(ji)(ji)本思路(lu)是:允(yun)許(xu)土(tu)地(di)(di)利(li)用(yong)(yong)總體規劃(hua)和(he)城鄉規劃(hua)確定為工礦(kuang)倉儲、商服等(deng)(deng)經(jing)營性(xing)用(yong)(yong)途(tu)的(de)(de)(de)存(cun)量農(nong)(nong)村(cun)集體建設(she)(she)用(yong)(yong)地(di)(di),與國(guo)有建設(she)(she)用(yong)(yong)地(di)(di)享有同等(deng)(deng)權(quan)利(li),在(zai)符合(he)(he)規劃(hua)、用(yong)(yong)途(tu)管(guan)制(zhi)(zhi)(zhi)(zhi)和(he)依(yi)法取得的(de)(de)(de)前(qian)提下,可以出讓、租(zu)賃(lin)、入(ru)股(gu),完善入(ru)市交易規則、服務監管(guan)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)和(he)土(tu)地(di)(di)增(zeng)值收(shou)益的(de)(de)(de)合(he)(he)理(li)(li)分(fen)配(pei)機制(zhi)(zhi)(zhi)(zhi)。宅(zhai)基(ji)(ji)地(di)(di)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)改(gai)(gai)革的(de)(de)(de)基(ji)(ji)本思路(lu)是:在(zai)保(bao)(bao)障農(nong)(nong)戶依(yi)法取得的(de)(de)(de)宅(zhai)基(ji)(ji)地(di)(di)用(yong)(yong)益物(wu)權(quan)基(ji)(ji)礎(chu)上,改(gai)(gai)革完善農(nong)(nong)村(cun)宅(zhai)基(ji)(ji)地(di)(di)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du),探(tan)索農(nong)(nong)民住(zhu)(zhu)房(fang)保(bao)(bao)障新(xin)機制(zhi)(zhi)(zhi)(zhi),對(dui)農(nong)(nong)民住(zhu)(zhu)房(fang)財(cai)產(chan)權(quan)作(zuo)出明確界(jie)定,探(tan)索宅(zhai)基(ji)(ji)地(di)(di)有償使用(yong)(yong)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)和(he)自愿(yuan)有償退(tui)出機制(zhi)(zhi)(zhi)(zhi),探(tan)索農(nong)(nong)民住(zhu)(zhu)房(fang)財(cai)產(chan)權(quan)抵押、擔保(bao)(bao)、轉讓的(de)(de)(de)有效途(tu)徑。
二是深(shen)化農(nong)(nong)村(cun)土(tu)(tu)地(di)(di)(di)承(cheng)(cheng)包(bao)(bao)(bao)(bao)經(jing)營(ying)(ying)制度改革。抓(zhua)緊修改有(you)(you)(you)關法律,落實中(zhong)央關于穩定農(nong)(nong)村(cun)土(tu)(tu)地(di)(di)(di)承(cheng)(cheng)包(bao)(bao)(bao)(bao)關系并保(bao)持長久不變的重大(da)(da)決(jue)策,適時(shi)就二輪承(cheng)(cheng)包(bao)(bao)(bao)(bao)期滿(man)后(hou)耕地(di)(di)(di)延包(bao)(bao)(bao)(bao)辦法、新的承(cheng)(cheng)包(bao)(bao)(bao)(bao)期限等內容提出(chu)具體(ti)(ti)方(fang)案。在基本完(wan)成農(nong)(nong)村(cun)集體(ti)(ti)土(tu)(tu)地(di)(di)(di)所有(you)(you)(you)權確(que)權登(deng)(deng)記(ji)頒證的基礎上(shang),按(an)照(zhao)不動(dong)產(chan)統一登(deng)(deng)記(ji)原(yuan)(yuan)則,加(jia)快推進(jin)宅基地(di)(di)(di)和(he)集體(ti)(ti)建設用地(di)(di)(di)使用權確(que)權登(deng)(deng)記(ji)頒證工作。明確(que)和(he)提升農(nong)(nong)村(cun)土(tu)(tu)地(di)(di)(di)承(cheng)(cheng)包(bao)(bao)(bao)(bao)經(jing)營(ying)(ying)權確(que)權登(deng)(deng)記(ji)頒證的法律效(xiao)力,擴大(da)(da)整(zheng)省推進(jin)試點(dian)范圍,總體(ti)(ti)上(shang)要確(que)地(di)(di)(di)到戶,從嚴(yan)掌握確(que)權確(que)股不確(que)地(di)(di)(di)的范圍。出(chu)臺農(nong)(nong)村(cun)承(cheng)(cheng)包(bao)(bao)(bao)(bao)土(tu)(tu)地(di)(di)(di)經(jing)營(ying)(ying)權抵押、擔保(bao)試點(dian)指導意見。在有(you)(you)(you)條件(jian)的地(di)(di)(di)方(fang)開展農(nong)(nong)民土(tu)(tu)地(di)(di)(di)承(cheng)(cheng)包(bao)(bao)(bao)(bao)經(jing)營(ying)(ying)權有(you)(you)(you)償退出(chu)試點(dian)。制定出(chu)臺完(wan)善草(cao)原(yuan)(yuan)承(cheng)(cheng)包(bao)(bao)(bao)(bao)經(jing)營(ying)(ying)制度的文件(jian),規范草(cao)原(yuan)(yuan)承(cheng)(cheng)包(bao)(bao)(bao)(bao)行為(wei)和(he)管(guan)理方(fang)式,充(chong)分調動(dong)廣(guang)大(da)(da)牧民保(bao)護(hu)和(he)建設草(cao)原(yuan)(yuan)的積極(ji)性。引(yin)導農(nong)(nong)村(cun)集體(ti)(ti)所有(you)(you)(you)的荒(huang)(huang)山、荒(huang)(huang)溝、荒(huang)(huang)丘、荒(huang)(huang)灘使用權有(you)(you)(you)序流轉。
三(san)是(shi)健全(quan)耕(geng)地(di)(di)(di)(di)(di)(di)(di)保(bao)護(hu)和(he)補(bu)(bu)(bu)(bu)(bu)償制度。嚴格實施土(tu)地(di)(di)(di)(di)(di)(di)(di)利(li)用(yong)總體(ti)規(gui)(gui)劃,加(jia)(jia)強(qiang)(qiang)耕(geng)地(di)(di)(di)(di)(di)(di)(di)保(bao)護(hu),全(quan)面開展永久基本(ben)農田(tian)劃定工作,實行(xing)特殊保(bao)護(hu)。完(wan)(wan)善(shan)(shan)(shan)土(tu)地(di)(di)(di)(di)(di)(di)(di)復(fu)墾制度,盤活土(tu)地(di)(di)(di)(di)(di)(di)(di)存(cun)量(liang),建(jian)(jian)立土(tu)地(di)(di)(di)(di)(di)(di)(di)復(fu)墾激勵(li)約束(shu)機制,落實生(sheng)產(chan)建(jian)(jian)設毀(hui)損耕(geng)地(di)(di)(di)(di)(di)(di)(di)的(de)復(fu)墾責(ze)任。加(jia)(jia)大中低產(chan)田(tian)改(gai)造力度,以(yi)增(zeng)加(jia)(jia)高產(chan)穩產(chan)基本(ben)農田(tian)、改(gai)善(shan)(shan)(shan)農業生(sheng)產(chan)條件和(he)生(sheng)態環境為目(mu)標,完(wan)(wan)善(shan)(shan)(shan)農村土(tu)地(di)(di)(di)(di)(di)(di)(di)整(zheng)治辦法。依(yi)法加(jia)(jia)強(qiang)(qiang)耕(geng)地(di)(di)(di)(di)(di)(di)(di)占(zhan)補(bu)(bu)(bu)(bu)(bu)平衡(heng)(heng)(heng)規(gui)(gui)范管理,強(qiang)(qiang)化耕(geng)地(di)(di)(di)(di)(di)(di)(di)占(zhan)補(bu)(bu)(bu)(bu)(bu)平衡(heng)(heng)(heng)的(de)法定責(ze)任,完(wan)(wan)善(shan)(shan)(shan)占(zhan)補(bu)(bu)(bu)(bu)(bu)平衡(heng)(heng)(heng)補(bu)(bu)(bu)(bu)(bu)充耕(geng)地(di)(di)(di)(di)(di)(di)(di)質量(liang)評價體(ti)系,確保(bao)補(bu)(bu)(bu)(bu)(bu)充耕(geng)地(di)(di)(di)(di)(di)(di)(di)數量(liang)到(dao)位、質量(liang)到(dao)位。完(wan)(wan)善(shan)(shan)(shan)耕(geng)地(di)(di)(di)(di)(di)(di)(di)和(he)基本(ben)農田(tian)保(bao)護(hu)補(bu)(bu)(bu)(bu)(bu)償機制。采(cai)取更有力的(de)措施,加(jia)(jia)強(qiang)(qiang)對(dui)耕(geng)地(di)(di)(di)(di)(di)(di)(di)占(zhan)補(bu)(bu)(bu)(bu)(bu)平衡(heng)(heng)(heng)的(de)監管,堅決防(fang)止占(zhan)多補(bu)(bu)(bu)(bu)(bu)少、占(zhan)優(you)補(bu)(bu)(bu)(bu)(bu)劣、占(zhan)水田(tian)補(bu)(bu)(bu)(bu)(bu)旱田(tian)現象,杜絕違規(gui)(gui)占(zhan)用(yong)林地(di)(di)(di)(di)(di)(di)(di)、濕地(di)(di)(di)(di)(di)(di)(di)補(bu)(bu)(bu)(bu)(bu)充耕(geng)地(di)(di)(di)(di)(di)(di)(di)。進(jin)一步落實耕(geng)地(di)(di)(di)(di)(di)(di)(di)保(bao)護(hu)政府領(ling)導干部離任審計(ji)制度。按照(zhao)有關(guan)法律(lv)法規(gui)(gui),完(wan)(wan)善(shan)(shan)(shan)和(he)拓展城鄉(xiang)建(jian)(jian)設用(yong)地(di)(di)(di)(di)(di)(di)(di)增(zeng)減掛鉤、“地(di)(di)(di)(di)(di)(di)(di)票(piao)”等試點,推動利(li)用(yong)城鄉(xiang)建(jian)(jian)設用(yong)地(di)(di)(di)(di)(di)(di)(di)增(zeng)減掛鉤政策支持易地(di)(di)(di)(di)(di)(di)(di)扶貧(pin)搬遷。
2.分(fen)類推進農(nong)村(cun)集(ji)(ji)體(ti)(ti)(ti)(ti)資(zi)產(chan)確(que)(que)權到(dao)戶和股(gu)份合作制(zhi)改革。在確(que)(que)認農(nong)村(cun)集(ji)(ji)體(ti)(ti)(ti)(ti)經(jing)濟組(zu)(zu)織成員(yuan)身份、全面核實(shi)農(nong)村(cun)集(ji)(ji)體(ti)(ti)(ti)(ti)資(zi)產(chan)基礎上,對土(tu)(tu)地(di)等資(zi)源性資(zi)產(chan),重(zhong)點(dian)是(shi)(shi)抓緊抓實(shi)土(tu)(tu)地(di)承包經(jing)營(ying)(ying)(ying)權確(que)(que)權登記頒證工作;對非經(jing)營(ying)(ying)(ying)性資(zi)產(chan),重(zhong)點(dian)是(shi)(shi)探索有(you)利(li)于提高公共(gong)服(fu)務能力的集(ji)(ji)體(ti)(ti)(ti)(ti)統一運營(ying)(ying)(ying)管理有(you)效機制(zhi);對經(jing)營(ying)(ying)(ying)性資(zi)產(chan),重(zhong)點(dian)是(shi)(shi)將(jiang)資(zi)產(chan)折(zhe)股(gu)量化(hua)到(dao)本(ben)集(ji)(ji)體(ti)(ti)(ti)(ti)經(jing)濟組(zu)(zu)織成員(yuan),賦(fu)予農(nong)民對集(ji)(ji)體(ti)(ti)(ti)(ti)資(zi)產(chan)更多權能,發展(zhan)多種形式的股(gu)份合作。健全農(nong)村(cun)集(ji)(ji)體(ti)(ti)(ti)(ti)“三資(zi)”管理監督和收益分(fen)配(pei)制(zhi)度(du)。明(ming)確(que)(que)集(ji)(ji)體(ti)(ti)(ti)(ti)經(jing)濟組(zu)(zu)織市場主體(ti)(ti)(ti)(ti)地(di)位。建立(li)符合實(shi)際(ji)需求的農(nong)村(cun)產(chan)權流(liu)轉交易(yi)市場,保障農(nong)村(cun)產(chan)權依法自愿公開公正有(you)序(xu)交易(yi)。現階段農(nong)村(cun)集(ji)(ji)體(ti)(ti)(ti)(ti)產(chan)權制(zhi)度(du)改革嚴(yan)格限定在本(ben)集(ji)(ji)體(ti)(ti)(ti)(ti)經(jing)濟組(zu)(zu)織內部(bu)進行,切實(shi)防止集(ji)(ji)體(ti)(ti)(ti)(ti)經(jing)濟組(zu)(zu)織內部(bu)少數人侵占(zhan)、支配(pei)集(ji)(ji)體(ti)(ti)(ti)(ti)資(zi)產(chan),防止外部(bu)資(zi)本(ben)侵吞、控制(zhi)集(ji)(ji)體(ti)(ti)(ti)(ti)資(zi)產(chan)。
3.深(shen)化林(lin)(lin)業(ye)(ye)和水利改(gai)(gai)革。實(shi)行(xing)最(zui)嚴格的林(lin)(lin)地用途管制(zhi)(zhi)制(zhi)(zhi)度。以放(fang)活(huo)經營(ying)(ying)權(quan)(quan)、落實(shi)處(chu)置權(quan)(quan)、保障收益權(quan)(quan)為重點,深(shen)化配套改(gai)(gai)革,完善(shan)集(ji)體林(lin)(lin)權(quan)(quan)制(zhi)(zhi)度。實(shi)行(xing)森(sen)林(lin)(lin)分(fen)類經營(ying)(ying)管理,完善(shan)林(lin)(lin)木(mu)采伐(fa)權(quan)(quan),管好公益林(lin)(lin)、放(fang)活(huo)商(shang)品林(lin)(lin),調(diao)動林(lin)(lin)農和社會力(li)量發(fa)展(zhan)林(lin)(lin)業(ye)(ye)的積(ji)極性。穩步推進(jin)國有(you)林(lin)(lin)場和國有(you)林(lin)(lin)區改(gai)(gai)革。研究提出加(jia)強天然(ran)林(lin)(lin)資源保護(hu)(hu)的指導意見,有(you)序(xu)停止天然(ran)林(lin)(lin)商(shang)業(ye)(ye)性采伐(fa)。開展(zhan)小(xiao)型水利工(gong)程(cheng)(cheng)管理體制(zhi)(zhi)改(gai)(gai)革,明確工(gong)程(cheng)(cheng)所有(you)權(quan)(quan)和使用權(quan)(quan),落實(shi)管護(hu)(hu)主體,促進(jin)水利工(gong)程(cheng)(cheng)良性運(yun)行(xing)。
