自然資源部發布深化“證照分離”改革進一步激發市場主體發展活力工作實施方案

  為貫徹落實《國(guo)(guo)務院關于(yu)深化“證(zheng)照分離”改革進(jin)一(yi)步激發(fa)市(shi)場主(zhu)體發(fa)展(zhan)活力(li)(li)的通(tong)知》(國(guo)(guo)發(fa)〔2021〕7號)有(you)關要求(qiu),在(zai)(zai)全(quan)國(guo)(guo)范(fan)圍(wei)內推進(jin)自然資源管理涉企經營許(xu)可事(shi)項“證(zheng)照分離”改革,持續深化“放管服”改革,在(zai)(zai)更大范(fan)圍(wei)推進(jin)照后(hou)減證(zheng)和簡化審批,創新和加(jia)強事(shi)中事(shi)后(hou)監管,進(jin)一(yi)步優化營商環(huan)境、激發(fa)市(shi)場主(zhu)體發(fa)展(zhan)活力(li)(li),制定本方(fang)案(an)。

  一、總體要求

  根據國發〔2021〕7號(hao)文件有關要求,《中(zhong)央(yang)層面設定的(de)涉企經營許可(ke)事項清單(dan)(2021年(nian)全國版)》規定的(de)自然資源(yuan)管(guan)理涉企經營許可(ke)事項,按照(zhao)直接取消(xiao)審(shen)(shen)批、實行(xing)告知承諾、優(you)化審(shen)(shen)批服務等方(fang)式分類(lei)推進行(xing)政審(shen)(shen)批制度改革(ge),力爭2022年(nian)底(di)前建立(li)簡約高效(xiao)、公(gong)正(zheng)透(tou)明(ming)、寬進嚴管(guan)的(de)行(xing)業(ye)準營規則,大(da)幅提高市(shi)場主體辦事的(de)便(bian)利度和可(ke)預期性。

  二、大力(li)推動(dong)照后減證和簡化審批

  (一)直接取消(xiao)審批(pi)。

  在全(quan)國范圍內,直接取消“城鄉(xiang)規(gui)劃編制單(dan)(dan)(dan)(dan)(dan)位(wei)丙級(ji)資(zi)(zi)(zi)質(zhi)(zhi)認定”“地(di)質(zhi)(zhi)災害(hai)(hai)(hai)危險性評估單(dan)(dan)(dan)(dan)(dan)位(wei)丙級(ji)資(zi)(zi)(zi)質(zhi)(zhi)審(shen)批(pi)(pi)”“地(di)質(zhi)(zhi)災害(hai)(hai)(hai)治(zhi)(zhi)(zhi)理(li)工(gong)程勘查單(dan)(dan)(dan)(dan)(dan)位(wei)丙級(ji)資(zi)(zi)(zi)質(zhi)(zhi)審(shen)批(pi)(pi)”“地(di)質(zhi)(zhi)災害(hai)(hai)(hai)治(zhi)(zhi)(zhi)理(li)工(gong)程設(she)計單(dan)(dan)(dan)(dan)(dan)位(wei)丙級(ji)資(zi)(zi)(zi)質(zhi)(zhi)審(shen)批(pi)(pi)”“地(di)質(zhi)(zhi)災害(hai)(hai)(hai)治(zhi)(zhi)(zhi)理(li)工(gong)程施(shi)工(gong)單(dan)(dan)(dan)(dan)(dan)位(wei)丙級(ji)資(zi)(zi)(zi)質(zhi)(zhi)審(shen)批(pi)(pi)”“地(di)質(zhi)(zhi)災害(hai)(hai)(hai)治(zhi)(zhi)(zhi)理(li)工(gong)程監理(li)單(dan)(dan)(dan)(dan)(dan)位(wei)丙級(ji)資(zi)(zi)(zi)質(zhi)(zhi)審(shen)批(pi)(pi)”“從事(shi)測(ce)繪活動(dong)的(de)(de)單(dan)(dan)(dan)(dan)(dan)位(wei)丙級(ji)資(zi)(zi)(zi)質(zhi)(zhi)審(shen)批(pi)(pi)”“從事(shi)測(ce)繪活動(dong)的(de)(de)單(dan)(dan)(dan)(dan)(dan)位(wei)丁級(ji)資(zi)(zi)(zi)質(zhi)(zhi)審(shen)批(pi)(pi)”等(deng)8項涉企經營許(xu)可事(shi)項。(責(ze)任單(dan)(dan)(dan)(dan)(dan)位(wei):國土空(kong)間(jian)規(gui)劃局(ju)、地(di)質(zhi)(zhi)勘查管理(li)司(si)、國土測(ce)繪司(si),省級(ji)自然(ran)資(zi)(zi)(zi)源主管部門按職責(ze)分工(gong)負責(ze))

  (二)實行告知(zhi)承諾。

  在全(quan)(quan)國(guo)范圍內,對(dui)“城鄉規(gui)(gui)劃編制單(dan)(dan)位乙級資(zi)質(zhi)認定” 涉企(qi)經營許可(ke)事項實(shi)行告知承諾(nuo)。實(shi)行告知承諾(nuo)后,依(yi)法列出(chu)經營許可(ke)條件,對(dui)因企(qi)業承諾(nuo)可(ke)以減省(sheng)的(de)審批(pi)材(cai)料,不再要(yao)求(qiu)(qiu)企(qi)業提(ti)供;對(dui)可(ke)在企(qi)業領證(zheng)后補(bu)(bu)交的(de)審批(pi)材(cai)料,實(shi)行容缺(que)辦理(li)、限期補(bu)(bu)交。對(dui)企(qi)業通過全(quan)(quan)國(guo)國(guo)土(tu)(tu)空間規(gui)(gui)劃行業管理(li)信息系統提(ti)交資(zi)質(zhi)申(shen)請資(zi)料并自(zi)愿作出(chu)承諾(nuo)的(de),一個工作日內完(wan)成對(dui)材(cai)料是(shi)否符合要(yao)求(qiu)(qiu)的(de)審查并作出(chu)審批(pi)決定。(責(ze)任單(dan)(dan)位:國(guo)土(tu)(tu)空間規(gui)(gui)劃局,省(sheng)級自(zi)然資(zi)源(yuan)主(zhu)管部(bu)門(men)按(an)職責(ze)分(fen)工負責(ze))

  (三)優化審批服務。

  1.在全國范圍內,對“城鄉規劃(hua)編制單位甲級資(zi)質認定”涉企(qi)經營許(xu)可事項,優化(hua)審批流程(cheng),壓縮辦理時(shi)限,提(ti)高審批效率。(責任(ren)單位:國土空間規劃(hua)局)

  3.對“勘查礦產(chan)資(zi)(zi)源(yuan)審批”“開采(cai)礦產(chan)資(zi)(zi)源(yuan)審批”等(deng)2項涉企(qi)經營許(xu)可事(shi)項,精簡審批材(cai)料,積(ji)極探索采(cai)取委托等(deng)方(fang)式、按照有(you)關授權(quan)(quan)(quan)分(fen)別(bie)將省(sheng)級自(zi)(zi)然(ran)資(zi)(zi)源(yuan)主管部門負(fu)責的部分(fen)探礦權(quan)(quan)(quan)、采(cai)礦權(quan)(quan)(quan)審批權(quan)(quan)(quan)限下放至(zhi)設(she)區(qu)的市、縣級自(zi)(zi)然(ran)資(zi)(zi)源(yuan)主管部門。(責任單位(wei):礦業權(quan)(quan)(quan)管理司,省(sheng)級自(zi)(zi)然(ran)資(zi)(zi)源(yuan)主管部門按職責分(fen)工負(fu)責)

  4.對“從事(shi)測(ce)(ce)繪(hui)活動的(de)單位(wei)甲級資(zi)(zi)質(zhi)審(shen)批”“從事(shi)測(ce)(ce)繪(hui)活動的(de)單位(wei)乙級資(zi)(zi)質(zhi)審(shen)批”等2項(xiang)涉企經營(ying)許可事(shi)項(xiang),精簡專業類別子項(xiang),將(jiang)除導航電子地(di)(di)(di)圖制(zhi)作以(yi)外的(de)其余9個甲級資(zi)(zi)質(zhi)的(de)審(shen)批權限,由自然(ran)資(zi)(zi)源部下(xia)放(fang)至省(sheng)級自然(ran)資(zi)(zi)源主(zhu)管部門。(責任單位(wei):國(guo)土測(ce)(ce)繪(hui)司(si),省(sheng)級自然(ran)資(zi)(zi)源主(zhu)管部門,陜西測(ce)(ce)繪(hui)地(di)(di)(di)理(li)信(xin)(xin)息(xi)(xi)(xi)局、四川測(ce)(ce)繪(hui)地(di)(di)(di)理(li)信(xin)(xin)息(xi)(xi)(xi)局、黑龍江測(ce)(ce)繪(hui)地(di)(di)(di)理(li)信(xin)(xin)息(xi)(xi)(xi)局、海南測(ce)(ce)繪(hui)地(di)(di)(di)理(li)信(xin)(xin)息(xi)(xi)(xi)局按職責分工負責)

  5.對“深海海底區域資(zi)源勘探開發許可”涉(she)企經營許可事(shi)項(xiang),優化審(shen)批流(liu)程,提(ti)高審(shen)批效率。(責任(ren)單(dan)位:中國大洋事(shi)務管理局)

  三、加(jia)強事中事后監(jian)管

  堅(jian)持放(fang)管結(jie)合、并重要求,按(an)照“誰(shui)審批、誰(shui)監(jian)管,誰(shui)主管、誰(shui)監(jian)管”的(de)原則,切實履行監(jian)管職責,防(fang)止(zhi)出現(xian)監(jian)管真(zhen)空。

  (一)明(ming)確(que)監(jian)(jian)管(guan)責(ze)任。直接取(qu)消(xiao)的,由原審批(pi)(pi)機關(guan)依法承擔監(jian)(jian)管(guan)職責(ze)。實行告(gao)知承諾、優化審批(pi)(pi)服(fu)務(wu)的,由審批(pi)(pi)機關(guan)負責(ze)依法監(jian)(jian)管(guan)、查(cha)處違法行為(wei)。

  (二(er))健全監管規則(ze)。直接取(qu)消(xiao)審(shen)批的(de),原審(shen)批機關要(yao)(yao)及(ji)時掌握(wo)有關情況,依(yi)法(fa)實(shi)施監管。實(shi)行告(gao)知承諾的(de),審(shen)批機關要(yao)(yao)重點(dian)檢查(cha)企(qi)業(ye)(ye)履行承諾情況;發現企(qi)業(ye)(ye)違(wei)反承諾的(de),要(yao)(yao)責令(ling)限期整(zheng)改,逾期不(bu)整(zheng)改或者(zhe)整(zheng)改后(hou)仍未履行承諾的(de),要(yao)(yao)依(yi)法(fa)撤(che)銷(xiao)許可。

  (三)完善監(jian)管(guan)方(fang)法(fa)(fa)。對(dui)一(yi)般(ban)行業(ye)(ye)、領域,全(quan)面推行“雙隨機(ji)、一(yi)公開”監(jian)管(guan),對(dui)投訴舉報等渠道反映(ying)問題多、嚴重(zhong)違法(fa)(fa)經營的企業(ye)(ye)實(shi)施重(zhong)點(dian)監(jian)管(guan)。對(dui)直接涉及公共安全(quan)和人民(min)群(qun)眾生命健康等特(te)殊(shu)行業(ye)(ye)、重(zhong)點(dian)領域,落實(shi)全(quan)覆蓋重(zhong)點(dian)監(jian)管(guan),強(qiang)化全(quan)過程質量管(guan)理(li)。進一(yi)步(bu)強(qiang)化信(xin)用監(jian)管(guan),依法(fa)(fa)依規(gui)實(shi)施失信(xin)懲(cheng)戒。

  四、工作要求

  (一)加強組織領導。各級自(zi)然資源(yuan)主管(guan)部(bu)門要(yao)(yao)高度重視深化(hua)“證照分離”改革工(gong)作(zuo),認(ren)真貫徹落實國發(fa)〔2021〕7號(hao)文件(jian)有關(guan)要(yao)(yao)求,強化(hua)主體責任,抓好工(gong)作(zuo)落實。部(bu)機關(guan)有關(guan)司局要(yao)(yao)及時(shi)與(yu)省級自(zi)然資源(yuan)主管(guan)部(bu)門做好溝通、指導和(he)支持。

  (二(er))加強改革法(fa)(fa)治保障。各級(ji)自然(ran)資源主管部門(men)要及時根據立(li)法(fa)(fa)工作權限和程序,抓緊推動有關(guan)規(gui)章和規(gui)范(fan)性文(wen)件的立(li)改廢,固化改革成果。

  (三)做(zuo)好改(gai)(gai)革(ge)政(zheng)策培訓和(he)(he)服(fu)務(wu)相(xiang)關工(gong)作(zuo)。各級(ji)(ji)自然資源主管部門要(yao)做(zuo)好改(gai)(gai)革(ge)政(zheng)策工(gong)作(zuo)培訓和(he)(he)宣(xuan)傳解讀,調整優化相(xiang)關業務(wu)流(liu)程,修訂完善(shan)相(xiang)關工(gong)作(zuo)規則和(he)(he)服(fu)務(wu)指南,改(gai)(gai)革(ge)升(sheng)級(ji)(ji)相(xiang)關信息系統,確保改(gai)(gai)革(ge)措施全面落實。
